OWNER-BUILDER'S AGREEMENT
To produce a series of seafaring vessels which are recognizably similar and of uniform high quality, and yet which are built by individuals, we feel it is important to retain contact with our builders. Unless the use of each set of plans is limited to one builder, that contact is lost. Variations on the plans may be made in consultation with the designer; in fact, such variations often lead to important developments in the designs. But, without contact, these developments are also lost. Therefore, we require a signed Owner-Builder's agreement to be enclosed with each plans order. This limits the uses and liabilities attendant to the designs and begins the designer-builder relationship with a clear understanding.
I, the undersigned, intend to build a sailing vessel known as:
__________________________________________________________________________________________
as designed by Jim Brown or John Marples. I hereby state my understanding of and agreement to the following provisions:
The plans and specifications are instruments of service and as such remain the property of the designer.
The plans and specifications are for the construction of one boat only, as built by myself, the undersigned . I will not let or have let the privilege of building from these plans to another individual, group, company, or corporation without written consent of the designer.
I will not copy, or allow to be copied or reproduced in any way, said plans and specifications, or any portion thereof.
I agree to follow said plans and specifications in the construction of the boat. I agree that any material deviation from the plans and specifications without the designer's prior written consent to such deviations, will require me, at the request of the designer, to refrain from identifying the boat with its class name or the designer's name.
Because the designer has no control over the actual fabrication of the boat, I agree that his responsibility shall end with providing said plans and specifications as available. I hereby waive all implied warrantees in regard to the above mentioned vessel design.
If said design is of the Constant Camber
series, I further understand that the license to manufacture only the number of Constant
Camber panels on a Constant Camber mold required for the completion of said boat is
granted by Jim Brown, by agreement with the designer. The Constant Camber construction
method is covered by U.S. patent 4,471,710.
